Trump’s DOJ turns to a court that hasn’t been used in 30 years to deport a woman
Nazira Haji Zada, who has not been charged with a crime, appeared in the Alien Terrorist Removal Court before Chief Judge Joan Ericksen, who normally serves as a federal judge in Minnesota.
The Justice Department on Thursday will bring its first case in a dormant court that allows the speedy removal of noncitizens suspected of terrorism.
A law review article once called it a “veritable zombie court.”
The woman facing the first-ever case in the Alien Terrorist Removal Court is challenging the constitutionality of the deportation tribunal, setting up a major test of the Trump administration’s decision to activate the court, which had never been used in its 30-year history.
